PROTECTED PLACES (SAFETY) (AMENDMENT) ORDINANCE, 1947.
Explanatory observations in accordance with Article XXVIII of the
Royal Instructions.
1.
This Ordinance was passed on the 29th December, 1947, to amend
the Protected Places (Safety) Ordinance, 1946, the principal Ordinance.

The reasons for enacting this Ordinance are set out in the
Objects and Reasons published with the Bill. A copy of such Bill is
forwarded herewith.

3. The principal Ordinance and the Ordinance under the report have
been the subject of correspondence terminating with telegram (No.1890
dated the 13th December, 1947,) from the Governor of Hong Kong to the
Secretary of State.
4. The Ordinance passed with one amendment. Such amendment was
made at the Committee Stage in passage of the Bill through Legislative
Council to provide in Section 9(1) of the principal Ordinance (as enacted
by Section 5 of the Ordinance under report) that termination of suspension
of the Ordinance shall occur upon resolution of the Legislative Council
and not by proclamation by the Governor as provided by the Bill in accordance
with the suggestion contained in para.5 of the Secretary of State's Secret
despatch (Hong Kong No.15 dated the 12th November, 1947.). Such change was
urged on the grounds that reservation to Legislative Council of the power
to bring the Ordinance back into effect following suspension would better
accord with constitutional usage.
5. It will be observed that by Section 3 of the Ordinance under
report, amendment of the principal Ordinance has been effected consequents
on the comments on Section 4(1)(b)(i) of the principal Ordinance contained
in the Secretary of State's Secret despatch (Hong Kong No.245) of the 28th
November, 1946.
